The Bombay High Court on Tuesday appointed retired Justice BN
Srikrishna to mediate the dispute between the Parsi Punchayat Trust and
Properties and some members of the community over construction of a
14-storey structure at Andheri for benefit of poor and needy
Zorastrians.
A division bench of Justice SA Bobde and Justice Mridula Bhatkar has directed the Parsi Punchayat and community members Bomy Patrawala and Parvez Firoze to remain present before the former Supreme Court judge on February 6. Land measuring 43,000 sq m at Panthaki Baug at Andheri was donated to Parsi Punchayat in 1966.It was to be used for Merit Rating Scheme under which housing at concessional rates is provided to the poor and deserving members of the Zoroastrian community.
The Parsi Punchayat had approached the HC in 2008 challenging the order of the Charity Commissioner of November 5, 2008 acting on a complaint lodged by Patrawala and Firoze. The trust had contended that the Charity Commissioner had unnecessarily interfered in implementation of the scheme by passing the order.
However, the parties filed consent terms in the HC on October 15, 2009. The HC then allowed Punchayat to dispose of remaining constructed flats to poor, needy and deserving Parsis. The order was subject to an undertaking from the Parsi Punchayat that they would construct the buildings within two years. At least 300 flats at Panthaki Baug were to be constructed and allotted to members of the community eligible under the scheme.
