The Bombay Parsi Punchayet (BPP) in a meeting on Tuesday decided to
extend help to the Parsi man who is embroiled in a custody dispute with
his wife. The Punchayet, however, refused to state the details of what
exactly the nature of help will be“as the matter is subjudice”, they
said. DNA in its April 22 issue reported the case, wherein the court
asked help from the Punchayet.
“As the court has asked for our help we took up the matter in the meeting. It was decided that I represent the Punchayet in the court and hear what the judge has to say,” said BPP chairperson Dinshaw Mehta, who is likely to appear before the court on Wednesday.
A division bench of justices PB Majmudar and AV Mohta of the high court had earlier asked either a trustee or the president of the Parsi Punchayet to remain present in the court on the next hearing on April 25. The hearing took place inside the judges’ chamber, but the order copy is available on the HC’s official website.
While clarifying that it was asking about accommodation for the husband, without prejudice to the rights and contentions of both the parties, the court said, “We would like to know from the Parsi Punchayet as to if, by way of interim solution for the time being, any of its accommodation either in Cusrow Baug or in any other premises, can be made available to the appellant for six months till the title suit is decided.”
The matter came up after an appeal was filed by the husband challenging the single-judge order restraining him from entering the south Mumbai flat, where the couple had been staying along with their minor daughter. The couple is in a matrimonial row, which is pending in the HC since 2009.
“We don’t know exactly what the judge wants, but from whatever we have in mind, we will play (our decision) to the ears and see what they have to say about what we have decided,” added Mehta.
